OVERVIEW
This website, merchantsmark.shop, is operated by Merchant’s Mark Trade Company LLC (“Merchant’s Mark,” “we,” “us,” or “our”). By visiting our site or placing an order, you agree to these Terms of Service, our Return & Refund Policy, our Shipping Policy, and any other policies posted on this site. If you do not agree, please do not use the site or place an order.

ELIGIBILITY
You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering on behalf of a business, you confirm you are authorized to bind that business to these terms.

CUSTOM ORDERS AND ARTWORK
When you submit a logo, artwork, text, or design for a custom order, you confirm that you own it or have the legal right to use and reproduce it. You agree to hold Merchant’s Mark harmless from any claims, damages, or costs arising from intellectual property you provide. We reserve the right to refuse any order containing content we believe infringes on the rights of others, including trademarked or copyrighted characters, logos, or game artwork, or content we consider offensive or unlawful.

USE OF YOUR ARTWORK
We will use your submitted artwork only to produce your order. We will not sell or license your designs to others. Unless you tell us otherwise in writing, we may display photos of finished products in our portfolio and on social media.

OUR DESIGNS AND CONTENT
All Merchant’s Mark branding, product designs, templates, photos, and site content are owned by Merchant’s Mark Trade Company LLC and may not be copied or used without written permission. Any design work, mockups, or templates we create for you remain our property until your order is paid in full.

PROOFS AND PRODUCTION
All custom orders require approval of a digital proof before production begins. Please review proofs carefully for spelling, colors, sizing, and layout. Once approved, the proof is final and production begins. Production typically takes 1 to 2 business days after proof approval. Production times are estimates and begin after proof approval and payment, not at the time of order.

PRICING AND PAYMENT
All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors and to cancel orders placed at an incorrect price, with a full refund issued. Custom orders must be paid in full before production begins. Wholesale payment terms are set by your wholesale account or invoice.

WHOLESALE ACCOUNTS
Wholesale pricing and Build a Bundle are available to approved business accounts only. We may approve, deny, or close wholesale accounts at our discretion. Applicants may be required to provide a valid resale certificate. Wholesale orders are subject to both these terms and your wholesale account terms; if the two conflict, your wholesale account terms control.

SHIPPING AND DELIVERY
Shipping rates and delivery times are described in our Shipping Policy. Delivery times are carrier estimates and are not guaranteed. Risk of loss passes to you once your order is delivered to the carrier. Please make sure your shipping address is correct; we are not responsible for orders shipped to an address entered incorrectly at checkout.

RETURNS AND REFUNDS
Returns, refunds, and defect claims are governed by our Return & Refund Policy. Custom and personalized items are not eligible for return except as described in that policy.

PRODUCT DESCRIPTIONS
We make every effort to display products and colors accurately, but we cannot guarantee that your screen displays colors exactly. Minor variations in color, material, and placement are a normal part of manufacturing.

LIMITATION OF LIABILITY
To the fullest extent permitted by law, Merchant’s Mark is not liable for any indirect, incidental, special, or consequential damages, including lost profits or lost sales, arising from your use of our site or products. Our total liability for any claim related to an order will not exceed the amount you paid for that order.

DISCLAIMER OF WARRANTIES
Products are provided as described on our site. Except as stated in our Return & Refund Policy, we make no other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.

GOVERNING LAW
These terms are governed by the laws of the State of Ohio. Any disputes will be resolved in the state or federal courts located in Ohio.

CHANGES TO THESE TERMS
We may update these terms at any time by posting the revised version on this page. Changes apply to orders placed after the update is posted.
